This action represents one of the first regulatory measures in Europe against NFTs that combine digital collectibles with chance-based rewards.
GESPA initiated the investigation after identifying possible gaming elements in the random NFT launches and in the reward mechanics of the system. According to Swiss law, any activity involving a wager, chance, and prize requires a local license, even if the operator is outside the country but offers services to Swiss users.
The regulator determined that the RTB and NFT tokens from FIFA Collect meet this definition. GESPA pointed out that these products lack a license in Switzerland and, therefore, are illegal, which is why the complaint was filed.
